Rain tax in 2022 - how to pay less?

The fee is aimed at property owners whose land plot is taken up more than 50% by impervious surfaces. That is, there are mainly buildings, concrete surfaces and paving stones on it. Rainwater drainage from the aforementioned goes directly into the sewer system. Such plots do not collect an adequate volume of rainwater according to retention. The amount of tax is largely dependent precisely on the degree of concreting of the plot. The fee applies to owners of properties as small as 600 m2. The tax in this version comes into effect in the second half of 2022. In practice, hospitals, workplaces, housing communities and cooperatives will pay more. The additional costs will primarily affect owners of single-family houses in developer-fenced estates.

Aims of additional rain tax 

The rain tax is a response to drought problems. The target is to increase rainwater retention. It is intended to encourage landowners to install rainwater management systems, plant trees and reduce impervious surfaces. Reducing the development rate is synonymous with reducing costs. The additional money from the rain tax is to be used mainly to reduce the effects of drought in Poland.

Exemption from rain tax

How to be exempt from rain tax or reduce the fees? Yes, it is possible and workable! The law says that the fee applies to owners whose plots are at least 50% developed. So the solution is to increase retention areas, plantings and install rainwater collection systems on the land. One of the best solutions is to install rainwater management systems due to the fact that they are efficient and take up little space. They are also designed for plots of relatively small area. 

The amount of fees in case of failure to meet the condition about the required retention area: 

  • PLN 1.50 zł/m2 applies to owners of land where there are no retention devices
  • Owners with retention infrastructure with a capacity of 10% of annual runoff will pay PLN 0.90 zł/m2
  • Capacity of 20-30% - PLN 0.45 zł/m2
Every year, local governments organize a package of rainwater retention subsidies. This is of great interest, as it provides real assistance in the implementation of investments. Mostly you can expect to cover up to 80% of eligible costs, or up to several thousand zlotys of support. In addition, the nationwide My Water program also operates in a similar way.
